Terms of sale and use
1. Seller
The service is published and sold by Stanislas Tribot La Spiere — EI, sole trader, 9 rue des Colonnes, 75002 Paris, France, SIREN 527 975 726. Email: contact@toobigtoshare.com. Full details are given in the legal notice.
2. Purpose
toobigtoshare allows a single file to be transferred through a secret link, in return for a one-off payment, at the price shown on the site at the time of the order. There is no account, no subscription and no personal storage space.
The service is reserved for businesses acting for the purposes of their trade. By placing an order you declare that you are acting in a professional capacity. The service is not intended for consumers.
Placing an order constitutes acceptance of these terms.
3. Essential characteristics of the service
- One file per transfer, up to 2 TB. A file above that limit is refused before any upload starts.
- A secret reading link, handed to the sender once the upload is confirmed.
- Retention for 3 days from the end of the upload.
- A limited number of file replacements before confirmation (3).
4. Price and taxes
The applicable price is the one shown on the site at the time of the order, per transfer, all taxes and charges included. French VAT included; the seller's intra-EU VAT number is FR28527975726.
The price shown at the time of the order is the price due. A later change of price has no effect on transfers already under way.
5. Order and payment
A card hold is registered without any charge when the link is created; the authentication check (3-D Secure) takes place at that moment. The charge is only made when the upload is confirmed, once the file has been received in full.
If no file is uploaded, or if the upload does not complete, nothing is charged. An unused authorisation expires by itself.
Payments are processed by Stripe. Card details never pass through our servers. The contract is formed when the upload is confirmed, which triggers the charge and the delivery of the reading link.
6. Performance and retention period
The service is performed immediately: the reading link is handed over as soon as the upload is confirmed.
The file is permanently deleted 3 days after the end of its upload, at the date and time shown on screen. No retention beyond that is guaranteed, and no restoration is possible after deletion. An upload link left unused expires after 30 days.
7. Right of withdrawal
The right of withdrawal is a consumer right. As the service is reserved for businesses, it does not apply.
Where article L. 221-3 of the French consumer code extends it to a business with no more than five employees, for a contract outside its main activity: since the service is fully performed as soon as the reading link is handed over, and therefore before the fourteen-day period expires, withdrawal can no longer be exercised once that hand-over has taken place (article L. 221-28 1°). By ticking the acceptance box before payment, you expressly request that immediate performance.
As long as the file has not been uploaded and confirmed, the transfer can be abandoned at any time: nothing is charged.
8. Warranties
The seller is bound by the obligation to deliver conforming goods (article 1604 of the French civil code) and by the warranty against hidden defects (articles 1641 et seq. of the same code). In the event of a defect, you may require it to be corrected or, if that is impossible, obtain a price reduction, or termination of the contract and a refund.
9. Refunds and complaints
Any complaint should be sent to contact@toobigtoshare.com, quoting the link concerned, and receives a reply within 5 working days.
Refunds are given in particular where: the upload did not complete although a charge was made, and where the file became inaccessible before the announced deletion date. Refunds are made to the payment method used.
No refund is due where unlawful content is removed (article 10), nor where you have circulated the reading link to third parties yourself.
10. Prohibited content
It is forbidden to upload any unlawful content, and in particular any content involving child sexual abuse, inciting hatred or terrorism, infringing copyright, or invading another person's privacy.
We reserve the right to delete any file reported or found to be unlawful, without notice and without refund, and to make the reports required by law. You remain solely responsible for the content you upload and for the rights you hold over it.
11. Reporting
Any content can be reported using the button on the viewing page, or by email to contact@toobigtoshare.com. How reports are handled is set out in the legal notice.
12. Access to the link
The reading link is the access right: anyone holding it can download the file. It is up to you to pass it only to the recipients of your choice. The upload link and the reading link are distinct: the person uploading a file does not obtain the address that allows it to be read.
13. Availability and liability
The service is provided as is. No guarantee is given as to uninterrupted availability of the service or as to the completion of any upload. Where an upload does not complete, nothing is charged.
Our liability cannot exceed the amount paid for the transfer concerned. It is up to you to keep a copy of your file: the service is a means of transport, not a backup.

15. Governing law and language
These terms are governed by French law. Failing an amicable settlement, any dispute falls within the exclusive jurisdiction of the courts of Paris.
These terms are translated from French for your convenience. In the event of any discrepancy, the French version prevails.
16. Amendment
These terms may be amended at any time. The applicable version is the one accepted at the time of payment; it is kept with the accounting record for the transfer.
